10.4. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded from these Terms.
11.1. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, void, or unenforceable for any reason, such provision shall be deemed severable from these Terms and shall not affect the validity, legality, or enforceability of the remaining provisions.
11.2. In the event that any provision is deemed invalid or unenforceable, the parties agree that the court should endeavour to give effect to the parties' intentions as reflected in the original provision, and the remaining provisions of these Terms shall continue in full force and effect.
11.3. The failure of Elka Technology Group to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if made in writing and signed by an authorised representative of the Company.
